medElink TERMS & CONDITIONS

These Terms and Conditions ("Terms") govern access to and use of the medElink portal ("Platform"). By creating an account or using the Platform, you agree to be legally bound by these Terms, which form a binding agreement between you and medElink.
1. About medElink
1.1 medElink ("we", "us", "our") operates an online professional referral, governance and coordination platform connecting rehabilitation case managers, healthcare professionals, personal injury solicitors, professional deputies, insurers and injured clients ("Users").
1.2 medElink is the trading name of Kinetic Health Holdings Limited, registered in England & Wales (company number: 12567617) with its registered office at:

1.4 These Terms are governed by the laws of England and Wales.
2. User Categories
2.1 The Platform supports the following user categories:
- (a) Rehabilitation Case Managers ("Case Managers")
- (b) Healthcare Professionals ("Practitioners")
- (c) Solicitors and Professional Deputies ("Professional Subscribers")
- (d) Injured Clients / Service Users ("Service Users")
2.2 All users except Service Users must complete onboarding, provide required identity and governance documentation, and maintain accurate and up-to-date professional information.
2.3 Service Users are invited onto the Platform by their Case Manager and are not required to undergo independent verification.
3. Governance, Verification and Professional Responsibility
3.1 Governance and professional standards are central to medElink. We verify submitted credentials during onboarding but rely on Users to ensure their information remains accurate and current.
3.2 Profiles may be automatically suspended where governance documentation expires or is not updated within required timeframes.
3.3 Case Managers and Practitioners remain bound by their own statutory, regulatory and professional obligations (including but not limited to HCPC, GMC, NMC, CSP, BPS, RCSLT or equivalent) and are solely responsible for their own compliance.
3.4 medElink reserves the right to suspend or remove any account where there are governance concerns, professional misconduct, safeguarding issues or breaches of these Terms.
4. Account Access and Security
4.1 Users are responsible for maintaining the confidentiality of login credentials and for all activity carried out under their account.
4.2 Accounts are personal and non-transferable. Sharing access credentials is prohibited.
4.3 medElink may suspend or restrict access where account security is compromised or these Terms are breached.
5. Nature and Use of the Platform
5.1 The Platform facilitates introductions, referrals and coordination between verified professionals and Service Users.
5.2 medElink does not deliver clinical, therapeutic or case management services.
5.3 Any contract for services (including assessment, treatment or reporting) is formed directly between the Case Manager and the Practitioner (or other relevant parties).
5.4 medElink acts solely as a facilitator and governance host and is not a party to any professional service agreement between Users.
6. Fees, Platform Charges and Subscriptions
6.1 Practitioner Fees
Practitioners retain 100% of their professional fees.
medElink charges a platform fee for work introduced through the Platform from a Case Manager to a Practitioner.
The platform fee is calculated as either:
- a percentage applied on top of the Practitioner's professional fee, or
- £4 per invoice,
whichever is greater. See fee Schedule
The platform fee does not form part of the Practitioner's professional fee.
6.2 Professional Subscriber Subscriptions
Solicitors and Professional Deputies may purchase an annual, per-user subscription.
This subscription grants access to search, identify and contact Case Managers and Practitioners through the Platform.
Subscription fees will be clearly disclosed prior to purchase.
6.3 Invoicing and Payments
Case Managers are responsible for submitting invoices to the appropriate fee payer (e.g. insurer, compensator or law firm).
medElink is not a debt collection agency and accepts no liability for unpaid invoices, though it may, at its discretion, assist with administrative follow-up.
7. Off-Platform Transactions
7.1 Users must not circumvent the Platform by arranging or accepting payment for medElink-introduced work outside the Platform where an on-platform payment process is available.
7.2 Any protection, fee structure or administrative support offered by medElink applies only to transactions processed through the Platform.
7.3 Breach of this clause may result in suspension or permanent removal of access.
8. Professional Standards and Safeguarding
8.1 Users must comply with all applicable professional codes, statutory obligations and data protection laws.
8.2 While medElink undertakes governance checks, Case Managers remain responsible for reviewing Practitioner credentials and insurance prior to instruction.
8.3 medElink accepts no responsibility for the professional acts, omissions or advice of any User.
9. Liability and Indemnity
9.1 The Platform is provided on an "as is" and "as available" basis.
9.2 To the maximum extent permitted by law, medElink excludes liability for indirect, consequential or economic losses arising from use of the Platform.
9.3 Users agree to indemnify and hold medElink harmless from claims, losses or expenses arising from their breach of these Terms or misuse of the Platform.
10. Suspension and Termination
10.1 medElink may suspend or terminate accounts without notice where:
- governance or safeguarding breaches occur
- false or misleading information is provided
- platform fees are circumvented
- professional misconduct is suspected
10.2 Users may close their account by written notice to support@medelink.co.uk. Data will be handled in accordance with the Privacy Policy.
11. Intellectual Property
11.1 All software, branding, content and materials on the Platform are owned or licensed by medElink.
11.2 Users may not copy, modify, distribute or reverse-engineer any part of the Platform without prior written consent.
12. Data Protection
12.1 Personal data is processed in accordance with the medElink Privacy Policy.
12.2 Users remain responsible for their own data protection compliance when handling Service User information outside the Platform.
13. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.
